DMCA Notice Review and Verification Process

This page explains how Jamie Review reviews, verifies, and handles copyright complaints.

1. Purpose

The goal of this process is to:

  • review notices fairly
  • prevent obvious abuse
  • respond to legitimate copyright complaints
  • document actions taken
  • provide a clear path for counter-notices where appropriate

2. Initial Review

When a DMCA complaint is received, we may first check whether it includes the required elements:

  • signature
  • identification of the copyrighted work
  • identification of the allegedly infringing material
  • enough detail to locate the material
  • contact information
  • required good-faith and perjury statements

If key information is missing, we may ask for clarification before taking action.

3. Verification Steps

We may take reasonable steps to verify a notice, including:

  • confirming the URL or page location
  • checking whether the complained-of content appears on our site
  • checking whether the notice appears complete
  • confirming whether the sender claims to be the rights holder or authorized agent
  • preserving internal records of the complaint

4. Temporary Action

If a notice appears substantially compliant, we may:

  • temporarily disable access to the content
  • remove the content
  • notify the affected contributor, if applicable
  • preserve evidence for recordkeeping

5. Notice to Affected Party

Where appropriate, we may notify the affected user, author, or content source and provide:

  • summary of the complaint
  • affected URL or content
  • date action was taken
  • counter-notification instructions

6. Counter-Notice Review

If we receive a counter-notice, we may review whether it includes the legally required elements. If it appears valid, we may forward it to the complaining party and handle the matter in line with applicable DMCA procedure.

7. Recordkeeping

We may keep records of:

  • original notices
  • follow-up communications
  • removal decisions
  • counter-notices
  • restoration decisions
  • repeat complaint history

8. Abuse Prevention

We reserve the right to reject, ignore, or seek clarification on notices that are:

  • incomplete
  • obviously abusive
  • unrelated to copyright
  • aimed at suppressing lawful criticism, commentary, or fair use

9. No Automatic Merit Finding

Our review of a notice is administrative, not a final legal determination that infringement occurred.
